Terms of service

These terms are the agreement between your salon and DragonflyPing, a business registered in Ontario, Canada. They cover everything we provide: the text-message front desk, the online booking page, the calendar, the texts we send for you, and any website we build for you. By signing up or using DragonflyPing, you agree to them. Our privacy policy explains how we handle personal information and is part of these terms.

1. Who can use DragonflyPing

  • DragonflyPing is for businesses, not for personal use. The person who signs up must be allowed to agree to these terms for the salon.
  • We serve salons in Canada, outside Quebec for now.

2. Your account and your team

  • You choose who on your team gets a login. You are responsible for what happens under your salon's logins.
  • Keep your sign-in details private. Tell us right away at support@dragonflyping.com if you think someone else got in.

3. Texting your clients

  • You must have your clients' permission to text them, as Canada's anti-spam law (CASL) requires, and keep a record of it. Clients who booked or bought from you in the last two years usually count. If you are not sure, ask us before a message goes out.
  • Every client list you give us must be your own salon's clients.
  • Texts go out in your salon's name and tell clients how to stop them. When a client replies STOP, we stop texting them right away.
  • You also agree to follow the rules of the company that carries our texts, Twilio: its Acceptable Use Policy and Messaging Policy.

4. The AI front desk

  • An AI writes replies to your clients' texts for your salon. It always tells clients it is an AI, and that cannot be switched off.
  • It answers from the information you give us: your services, prices, hours and policies. Keep that information up to date.
  • The AI can make mistakes. When it can't answer, it passes the conversation to you. Check anything important yourself, such as prices and appointment times.
  • It must not be used to give medical advice, such as about skin conditions, allergies or infections.
  • You agree to follow the usage rules of the company that makes the AI, Anthropic: its Usage Policy.

5. What you can't do

  • Send spam, or text people who haven't agreed to hear from you.
  • Send anything illegal, misleading, hateful or harassing.
  • Try to get into another salon's information, or into parts of DragonflyPing you weren't given.
  • Copy, resell or take apart DragonflyPing.

If you do, we may pause or end your service (see section 9).

6. Your information belongs to you

  • Your client list, appointments and messages belong to your salon. We use them only to provide DragonflyPing to you, as our privacy policy explains. We never sell them.
  • Photos, logos and words you give us for your website or booking page must be yours to use. You let us use them only to build and run your pages.
  • DragonflyPing itself, the software and our designs, stays ours.
  • After you leave, you have 30 days to ask for a copy of your salon's information. After that we delete it. Our backups clear it within a further 30 days.

7. Fees and payment

  • You pay the price of your package each month, in advance. Your package renews every month until you cancel.
  • Prices do not include sales tax (HST). Tax is added on your invoice.
  • If we change a price, we email you at least 30 days before it applies to you. You can cancel before then.
  • If a payment fails, we'll tell you. If it isn't fixed within 14 days, we may pause your service until it is.

8. Cancelling

  • You can cancel any time by emailing support@dragonflyping.com. Your service runs until the end of the month you've paid for.
  • We don't refund part-months. If we end your service without you doing anything wrong, we refund the unused part of that month.

9. When we can pause or end your service

  • We may pause or end your service if you break these terms, don't pay, or if a carrier or the law requires it.
  • When we can, we tell you first and give you time to fix the problem. We act right away only to stop harm, such as spam going out.

10. Other companies we rely on

DragonflyPing uses other companies to work, including phone carriers, Twilio for texts, Anthropic for AI, and Google for sign-in. We choose them carefully, but we are not responsible for their outages or for a carrier blocking or delaying a text.

11. No guarantees

We work hard to keep DragonflyPing running and correct, but we provide it "as is". We don't promise it will never be down, that every text will be delivered, or that every AI reply will be right. We don't promise any particular number of bookings or amount of revenue.

12. The most we owe you

If something goes wrong, the most DragonflyPing owes you is what you paid us in the 12 months before it happened. We are not responsible for lost profits, lost bookings or other indirect losses. This limit does not apply to fraud or harm we cause on purpose.

13. If someone makes a claim because of your texts

If someone makes a claim against DragonflyPing because of texts you had us send without permission, a client list that wasn't yours, or content you gave us, you cover our reasonable costs of that claim.

14. Changes to these terms

If we make an important change to these terms, we email you at least 30 days before it takes effect. If you don't agree, you can cancel before then. Small fixes, like typos or clearer wording, take effect when we post them. The date at the top always shows the latest version.

15. Ontario law

Ontario law and the laws of Canada that apply in Ontario govern these terms. Any dispute goes to the courts of Ontario. Before going to court, we both agree to try to settle it by talking first.
